The half brother of Dane Cook has been ordered held on $1 million bail on charges alleging he stole millions of dollars from the comedian.

Darryl McCauley pleaded not guilty to eight counts of larceny over $250, forgery and larceny by continuous scheme. Prosecutors said at Thursday’s arraignment in Middlesex Superior Court that more charges are expected.

Prosecutors say the 43-year-old McCauley stole the money while being paid $12,500 a month to act as business manager for Cook’s company, Great Dane Enterprises.

Defense attorney Robert Goldstein said McCauley denies taking any money without his brother’s consent. Goldstein, who asked for $100,000 bail, said Thursday that McCauley and Cook were “virtual partners” who together built Cook’s career.

A pretrial conference is set for April 16.

WHILE Dane Cook’s 15 minutes of fame are, sadly, not up yet, the not-so-funnyman’s time in his beloved apartment has come to an end. The LA sheriff’s office slapped Cook with an eviction notice after he repeatedly failed to clean up after his dog. But Cook, who just bought a $7 million house in the Hollywood Hills, went back to court last week to appeal, claiming the eviction caused him “emotional hardship” and that the apartment inspires him creatively. The plea didn’t work.

The comic spent yesterday in a Beverly Hills courthouse fighting allegations that his mini-Pinscher drops his load all over his apartment complex, a story Page Six broke in April. We reported Cook was at war with management of La Fontaine in West Hollywood for not cleaning up after his pooch, Beast. “Neither he nor his girlfriend pick up after the dog,” said our source. “They’ve sent him three notices so far over the last year warning him he’ll be evicted, and they have video. The neighbors all hate him.” The case went to trial on Tuesday. Cook’s mouthpiece, Ina Treciokas, told us in April: “Dane vigorously denies the allegations in the complaint and is looking forward to complete vindication through the legal proceedings.” But he couldn’t have enjoyed watching videos played for the jury yesterday of Beast doing his duty in the complex.

DANE Cook isn’t only despised by other comedians and the public in general, he’s now hated by his Los An geles neighbors. THERE’s nothing amusing about Dane Cook, according to fellow comics and two Boston radio personalities who are about to name him “The Unfunniest Comic” this afternoon.

WBCN jock Fred Toucher, who co-hosts a talk show with Rich Shertenlieb weekday afternoons in Boston, says Cook is the overwhelming favorite in a tournament patterned after NCAA basketball’s March Madness, where he’s ahead of Jay Leno, Jeff Foxworthy, Carlos Mencia and Paula Poundstone.

“We were talking about how people laugh out loud at nonsense and Dane is a good example of that,” Toucher told Page Six. “We’d listen to him and at the end of four minutes he’d change subjects, and that was it. We couldn’t figure out when the joke was.

“And he’s actually hated. People don’t hate others they way they do him. At least Foxworthy panders to rednecks. Dane’s stories are so weak you wouldn’t want to hear them over lunch.”

Cook, 36, has been accused of stealing jokes by Louis CK, Demetri Martin, Joe Rogan and others. And the big-headed comic is also known for his huge ego and his diva-like demands.

The star of such movie stinkers as “Employee of the Month” and “Good Luck Chuck” allegedly was also once tossed out of Smith & Wollensky steak house because he was so difficult. “His assistant ordered for him. He got a steak and sent it back three times,” said one employee. “The chef was furious. Eventually we told him enough is enough.”

And one insider on the set of the TBS World Series commercials Cook filmed last year said he demanded blocks of tickets for postseason games in return for filming the commercials for free.

“He doesn’t recall ever being to Smith & Wollensky,” said Cook’s spokeswoman Ina Treciokas. “He did go to Houston’s when he was in town a few weeks ago and ordered chicken, which he did not send back. As for the [baseball] campaign, he did it for free. In return, they gave him two tickets to any baseball game over the next three years, and he’s been to five games so far.” Treciokas added: “He is a triple-platinum artist who’s sold 32,000 tickets on his last tour in Boston and 365,545 tickets in 25 cities over the course of the entire tour.”

Like him or hate him, you have to admire Dane Cook’s willingness to meet a challenge head on.

The popular but polarizing comedian set a new record for standup when he did seven consecutive hours at Hollywood’s Laugh Factory starting around midnight New Year’s Day and ending close to 7 a.m. Wednesday. It was the latest salvo fired in what has become an interesting rivalry with fellow comic Dave Chappelle, whose record of six hours and 12 minutes Cook obliterated Wednesday morning.

It all started back in April 2007 when Cook broke the club’s long-standing record for a single standup show when he did three hours and 50 minutes, eclipsing the near-three hour mark set by the late, great Richard Pryor in 1980. A few weeks later, Chappelle came in and did six hours and seven minutes, which stood until December 4, when he surpassed his own best by five minutes.

Then, along came Cook to get his record back. Someone please alert the Guinness Book of World Records.

“I never sat down or left the stage,” he wrote on his website later that day. “The show started with a small mighty crowd of aruond 60, and 35 of us were together this mornnig still laughing and recappnig 2007 with laughs galore. It felt fantastic.”

Jessica Simpson has fueled speculation she’s back in the arms of comedian Dane Cook after joining him at Prince’s VIP concert at Los Angeles’ Roosevelt Hotel on Saturday. The couple reportedly dated while shooting the movie Employee Of The Month together – and guests at Prince’s latest show were left in no doubt the pair are still close.

According to witnesses, Simpson and Cook sat next to each other on a sofa, often talking into each other’s ear over the music.

A source tells Life & Style magazine, “They were laughing, joking and hanging out. They practically spent all night together, dancing and touching each other.”

Simpson has recently been dating bluesman John Mayer, but their romance has reportedly ended.
