As the investigation surrounding Heath Ledger’s accidental overdose continues, the federal Drug Enforcement Administration office in New York has confirmed to Access Hollywood that they have issued a subpoena that would force Mary-Kate Olsen to testify in front of a grand jury.
Five medications were found in Heath’s body at the time of his death, according to the DEA, three of which he’d obtained via doctors in Texas and Los Angeles. At the center of the investigation is how he acquired Oxycontin and Vicodin without a legal prescription.
The actress was the first person called by the masseuse who discovered Heath’s body after the “The Dark Knight” actor’s untimely death.
She broke her silence for the first time on Monday, when a rep for the actress told Access in a statement that she “had nothing whatsoever to do with the drugs found in Heath Ledger’s home or his body, and she does not know where he obtained them.”
However, despite the rep’s statement that they “have provided the Government with relevant information,” the actress is reportedly refusing to speak to government officials without immunity.
According to Benjamin Brafman, a high-profile defense attorney not associated with the case, seeking immunity is not the same as admitting guilt.
“It may not mean anything other than she’s getting good legal advice,” Brafman told Access.
“You don’t know what the DEA may suspect in this case and I think it’s a cautious way to proceed. I think it would be wrong to assume she’s done something criminal simply because she’s invoking her 5th amendment against self-incrimination.”

Mary-Kate Olsen Wants Immunity Before Speaking To The Feds About Heath Ledger

Pint-size actress Mary-Kate Olsen has refused to be interviewed by federal investigators probing the accidental drug death of her close friend Heath Ledger unless she receives immunity from prosecution, The Post has learned.
The actress’ lawyer has repeatedly rebuffed attempts by the feds to question Olsen, who was the first person called after her masseuse discovered Ledger’s body in his SoHo apartment in January.
Frustrated federal officials could obtain a grand-jury subpoena to compel the funky “Full House” actress to tell them whatever she knows about the “Dark Knight” star’s behavior, his possible drug use and the events of that fateful morning, according to sources.
Probers have interviewed everyone connected to Ledger and his death, including his doctors, the masseuse, bodyguards, housekeepers, business associates and even the mother of his 2-year-old daughter, Matilda, his “Brokeback Mountain” co-star Michelle Williams.
“Ms. Williams was extremely nice and cooperative,” a source said.

Another added, “Everyone has been very eager to help, saying what a great guy Heath Ledger was, everyone except Mary-Kate, who has refused to speak.”
That source explained that Olsen would be the final witness they need to conclude their investigation into where he got his drugs and medicines.
Ledger – whose performance as the Joker in “The Dark Knight” has ignited Oscar buzz – died of a potent cocktail of prescription drugs and OxyContin, the latter of which was likely obtained illegally.
His death was ruled an accidental drug overdose by the medical examiner.
And NYPD investigators closed their probe without interviewing Olsen because, they said, they got all the cooperation they needed from others. That decision, however, surprised some observers, considering Olsen’s role as a potential witness.
Instead of calling emergency responders after getting the call from her masseuse, Olsen telephoned her bodyguards in the Big Apple, telling them to race to Ledger’s Broome Street home, where they arrived just as paramedics got to the scene.
The US Drug Enforcement Administration, which opened an investigation to determine the sources of Ledger’s drugs, was not as sanguine as the NYPD about talking to the 4-foot-11, 90-pound Olsen.
The feds contacted her lawyer, Michael Miller, several times recently seeking her cooperation, but Miller has told the feds Olsen won’t be interviewed unless she gets immunity, exercising her constitutional rights.
According to sources, all of the drugs in Ledger’s body and discovered nearby in prescription bottles were legally obtained from two physicians – with the exception of OxyContin, a powerful painkiller.
Investigators “are trying to ID the source of the OxyContin,” a source said. “Did it come from a dealer, from a friend? If he had a bottle from a friend, was it taken by someone else before police responded? That is what is trying to be determined.”
The DEA probers were also aggressive with the NYPD, the sources said, and were forced to threaten to obtain a grand-jury subpoena before getting the department’s Ledger files.
An NYPD spokesman said the department never balked at handing over the files and did so after receiving a routine federal administrative subpoena.
Asked whether he asked for immunity for his client, Olsen’s lawyer said, “We are not going to comment on whether there is a criminal investigation,” and declined to speak further.
The sources said Ledger’s employees reached out to Olsen because they panicked at finding his body and did not know what to do.
As for the bodyguards, they claimed they responded only to offer help.

Heath Ledger’s Uncle Arrested

Heath Ledger’s uncle Haydn has been charged with stealing and receiving.
According to the local reports, Haydn, 52, and another man allegedly stole three bobcats from local businesses in the late actor’s hometown during June and July.
Police spotted a man, believed to be Haydn’s accomplice, asleep in the driver’s seat of a truck outside a machinery sales office in the early morning hours Wednesday.
After executing a search warrant at the business, they discovered three missing Bobcat tractors (worth $137,000) and a tomahawk.
Drugs were allegedly also found on the driver, according to the paper.
The news comes days after Ledger’s family flew to NYC to attend The Dark Knight premiere.
As he left the screening, Ledger’s father Kim (Haydn’s brother) gave reporters a thumbs-up.

Heath Ledger’s family attended Monday’s The Dark Knight premiere in New York, where the late actor’s father left the theater giving a thumbs-up sign.
Kim Ledger and his wife Ines – Heath’s stepmother – bypassed the red carpet and ducked into the theater to watch his late son play The Joker in the latest Batman film.
Also attending the premiere were Heath’s mother Sally Bell and her husband, and Heath’s older sister, Kate.
As his father Kim left, he was asked how it felt to attend, responding with the thumbs-up. He also told reporters it was “very good.”
Heath Ledger’s costars, meanwhile, used the occasion to pay tribute to him.
“Working with Heath was fantastic,” said Christian Bale, 34, who reprises his role as the Caped Crusader. “He steals the movie and I’m quite happy to say that. He’s a hell of a talent and created a joker that’s very iconic and one that will become a classic portrayal of the ages.”
Michael Caine, 75, who plays butler Alfred Pennyworth in the film, which opens July 18, noted the “intensity and ferocity of the performance.”
“But when we were sitting down between takes, he was completely ordinary,” Caine added. “He wasn’t preparing himself or saying ‘Please leave me alone, I’ve gotta do this.’ Instead he was talking to me.
“We would sit and chat and have a cup of coffee, then suddenly they’d say, ‘We’re ready, Heath,’ and he’d go straight into The Joker,” Caine continued. “His energy was astonishing, especially when it came from this kind of calm. He’s certainly the best villain I’ve ever seen.”
Melbourne-based Robert Collins, a Ledger family friend for 30 years and co-executor of the Ledger will, told Who magazine in Australia he saw The Dark Knight preview in Perth last night and described it as “a eerie feeling” watching him.
“I am aware that Kim Ledger and the family are over in New York for it, it was something they felt they had to do and it was a personal thing from their point of view,” said Collins.
Ledger, who died of an accidental prescription-drug overdose on Jan. 22 has garnered Oscar buzz for his role as the smiley yet sinister Joker. Anticipation for The Dark Knight has been at a fever pitch with midnight shows having sold out so quickly that theater owners have had to continue to adding 3 a.m. and 6 a.m. showtimes.

Heath Ledger’s Family Shut His Daughter Out Of The Will

HEATH Ledger’s father, Kim, mother, Emma, and other family members are flying in for the “Dark Knight” premiere on July 14 for what some are calling a “sort of tribute” to him – but don’t expect to see his ex, Michelle Williams, or daughter, Matilda. An insider said, “Michelle is furious with Heath’s family and threatening to boycott the premiere. Matilda is supposed to be the beneficiary of the will, but Michelle has seen nothing from them. Heath didn’t have much in cash, but there was a big house in LA and a back-end deal for ‘Dark Knight’ [that] could reap millions.” Ledger’s will, made out in 2003 before Matilda was born, left everything to his father, mother and sisters. But Matilda is now considered the beneficiary, and Kim is the executor. Williams fears that by the time Matilda reaches 18 and can cash in on her inheritance, nothing will be left. Years ago, Kim’s brothers charged that he mismanaged their father’s estate, losing millions. A rep for Williams didn’t return repeated calls.

The party Calvin Klein Inc. threw the other night for its new perfume, Secret Obsession, was supposed to be held at the Broome Street building where Heath Ledger died. But just minutes before it was to start, company reps e-mailed invitees that the event was canceled. Then they sent e-mails saying it was moved to Barolo on West Broadway. “People said the landlord of Heath’s building had a problem, but it may have been because the Klein people thought it was in such bad taste to have it there,” said an insider. Another guest said the substitute venue was a “mess” with “bright lighting, no music and angry guests.”

Heath Ledger may have fathered love child during schoolboy affair with married woman

Heath Ledger’s family believe the late actor may have fathered a secret love child, according to a news report in Australia.
Ledger was a 17-year-old schoolboy when he had an affair with an older woman who is thought to have only discovered she was pregnant after their relationship ended.
The woman was living with another man at the time of the alleged affair.
If it is confirmed Ledger is the girl’s biological father, it could split his multi-million dollar estate between his two-year-old daughter Matilda Rose with Hollywood actress Michelle Williams, and his secret love child.
Ledger’s uncle, Hadyn Ledger, in Heath’s home town of Perth, Western Australia, told Sydney’s Daily Telegraph newspaper exclusively: “There is a very real possibility that Heath was the father.
Ledger, who died alone in his New York apartment in January from an accidental overdose of prescription drugs, drew up his will before the birth of Matilda, on whom he doted.
The April 2003 will lists only $145,000 in assets and names the late actor’s father, Kim, mother Sally Bell, sister Kate Ledger and half sisters Olivia Ledger and Ashleigh Bell as the only beneficiaries.
The New York documents also acknowledge Matilda Rose, as Ledger’s only known child, as an interested party.
The latest report states that Heath was still at school at Guildford Grammar in Perth when he began the affair with the woman, then aged 25.
Another family source told the newspaper: “She had the baby. Everyone lived under the assumption that she was the daughter of the mother’s boyfriend and that is how she has been brought up.”
The woman is now married with a young family. Ledger’s death has exposed the bitter rift in the family between father Kim and his estranged brothers, Haydn, Mike and Wayne.
The family feud began when Kim became executor of their grandfather, Sir Frank Ledger’s estate over 20 years ago.
He borrowed heavily against the $2 million estate, leaving it heavily in debt before he was removed as executor by the Western Australia Supreme Court in 1994.

Heath Ledger’s Family Feuds Over his Estate

Heath Ledger’s uncles are speaking out against his father Kim’s handling of the actor’s assets, saying Kim has a bad track record of estate management.
Ledger’s father so mishandled the management of their grandfather’s estate 15 years ago in Australia that Kim was removed as executor, the uncles claim.
“It plunged into enormous debt,” Mike Ledger, one of Kim’s brothers, tells PEOPLE.
Heath died in January at age 28 of an accidental mixture of prescription drugs – leaving behind a daughter, Matilda, by his ex, actress Michelle Williams. His will, written before his relationship with Williams, leaves everything to his parents and sisters.
Ledger’s uncle Mike insists the family has nothing to gain by removing Kim: “Our only vested interest is to assure that Matilda is well looked after.”
Mike added that Kim’s recent statement that Matilda “will be taken care of” was not enough assurance. “When you are talking about large sums of money like this,” he says, “it should be an independent executor, but Kim hasn’t chosen that way.”
Williams’s Father Raises Questions
Another of Kim’s brothers, Hayden, tells PEOPLE that Williams’s father, Larry, asked him if Kim was capable of managing the actor’s estate. “I just said, ‘No, not if he handles it like ours,’ ” he says.
The bitter dispute among the brothers dates back more than 15 years, when Kim became an executor of their grandfather Sir Frank Ledger’s estate, which they estimate was worth about $2 million in the mid 1980s. The family patriarch was a respected engineer in Perth.
According to the newspaper The Australian, Frank’s daughters filed a motion in Supreme Court asking to have Kim removed as the executor. The submission to the court stated that Kim’s handling of his grandfather’s estate “placed the assets at risk.” A report in Australia’s The Sunday Times says that a Supreme Court judge eventually removed Kim from overseeing the estate.
Ledger Family Friend Defends Kim
Robert John Collins – an Australian executor of Heath’s will who has known the Ledger family for 30 years – said last week that Mike and Hayden’s allegations about Kim were “rubbish.”
Kim and his brothers have remained estranged since the dispute. In fact, Mike says that 17 family members weren’t even invited to attend Heath’s memorial and funeral in Perth.
“I’m his godfather,” Mike says. “We didn’t even have the ability or the opportunity to pay our last respects to Heath. And I tell you, that is terrible – that is so sad.”
