Heather Locklear and ex-husband Richie Sambora are embracing the spirit of Thanksgiving by celebrating the holiday together – along with Locklear’s boyfriend – this year.

“Richie and Heather are spending Thanksgiving together with [daughter] Ava,” a friend of Locklear’s tells PEOPLE. “Jack [Wagner] and a few good friends will also be having dinner with them.”

Locklear, 47, and Sambora, 49, split in 2006 after 12 years of marriage, but they continue to be supportive of each other, and to co-parent their 11 year old daughter.

“They may be divorced, but they are raising a little girl they both love very much,” a friend of the Bon Jovi guitarist told PEOPLE in June after Locklear sought treatment for depression and anxiety.

“Heather and Richie are very supportive of each other,” Locklear’s friend adds. “They talk all the time, and anytime Ava has something important happening they are there together. It’s going to be a very nice Thanksgiving for everyone.”

Sambora, who was a presenter at Sunday’s American Music Awards, tells hollyscoop.com that “everything is really cool,” between him and his ex-wife.

He also tells the site, which broke news of their Thanksgiving plans, that Locklear is “doing fantastic” following her DUI arrest in September.

Heather Locklear has been formally charged with driving under the influence of drugs in connection with her September arrest, the Santa Barbara, Calif., District Attorney’s Office said Monday.

The misdemeanor charge filed by the DA’s office specifies that the drugs in question were “prescription medications.” If convicted, the actress, 47, faces penalties ranging from a fine to up to six months in county jail.

An arraignment was set for Jan. 26 in Santa Barbara Superior Court.

“Lab tests showed she had no alcohol in her system and no illegal narcotics of any kind,” says Senior Deputy District Attorney Lee Carter, who declined to comment on what medications – or the amounts – Locklear had taken.

“We believe that the prescriptions she was taking could have impaired her ability to drive a motor vehicle safely,” says Carter.

Locklear was originally booked on charges of driving under the influence of drugs and being under the influence of a controlled substance. The latter charge was not filed because, says Carter, “There were no illegal substances in her system.”

In addition, felony charges for Locklear “were not a possibility,” because DUI cases with no injuries are always misdemeanors, he said.

A Paparazzo Tip
The former Melrose Place star was arrested Sept. 27 in Montecito after an eyewitness – who turned out to be a paparazzo – called 911, saying Locklear was “driving erratically.”

In July, Locklear completed four weeks of treatment for anxiety and depression.

Locklear’s attorney and publicist both declined comment.

A photographer who called 911 to report Heather Locklear allegedly driving erratically runs a paparazzi agency and profited from images she took of the actress’s subsequent arrest, the woman’s attorney said Wednesday.

But Nicholas Tepper, who represents photographer Jill Ishkanian, said in a written statement Wednesday that her phone call to authorities was motivated by “civic duty” and a concern for Locklear’s safety.

He also defended Ishkanian’s right to then take photos of the arrest.

“The fact she witnessed Ms. Locklear’s erratic driving and reported it to the police did not mean she was disqualified from reporting the story, which she in fact did,” Tepper wrote.

He said Ishkanian then sold the photos to celebrity gossip site TMZ for $27,000 – but did it through a third party, KM Press Group, because her standing in the industry has been damaged by a lawsuit against her former employer, US Weekly.

In its postings this week, TMZ questioned whether Ishkanian was “up to no good” and claimed she alerted fellow paparazzi to Locklear’s impending arrest. TMZ head Harvey Levin said Wednesday that the owner of KM Press Group has repeatedly told him that one of the agency’s photographers snapped the photos and that Ishkanian called to tip him off to Locklear’s arrest.

Tepper said Ishkanian had been visiting family and friends in the Montecito area when she spotted Locklear’s car driving erratically Saturday afternoon, called 911 and was advised by a CHP dispatcher to stop following the car.

But Levin said some of the pictures appear to be taken well before Locklear’s arrest, and questioned Tepper’s contention that Ishkanian just happened to run into her acting erratically at a market. At least one of the photos shows Locklear coming out of a shop.

Tepper initially said Ishkanian took all the photos after phoning authorities. But when pressed about the image of Locklear appearing to leave a store, he said he wasn’t sure about the sequence that the photos were taken in, only that Ishkanian shot them all.

Levin said he did not consider the photos tainted. “Ultimately, these are photographs of an arrest.”

The California Highway Patrol, which would not confirm the identity of the 911 caller, said she didn’t identify that the driver was Locklear, but said the actress appeared “drunk” in a market. The CHP said in a news release that Locklear showed “obvious impairment,” but alcohol has been ruled out.

Santa Barbara County prosecutors will have to decide whether to pursue charges after test results are returned that could show whether Locklear was under the influence of other substances.

CHP Lt. Dane Lobb said Wednesday that Ishkanian’s involvement would not change what was going forward as a regular DUI investigation. “We determined (Locklear) was someone who shouldn’t be operating a vehicle,” he said.

Locklear’s attorney, Blair Berk, did not return an e-mail message seeking comment Wednesday evening.

Tepper later said in an interview that Ishkanian also provided authorities with a statement and would testify against Locklear if necessary. He said Ishkanian sold the photos without disclosing that she was the shooter because of her $55 million lawsuit against US Weekly; that suit claims the magazine’s employees damaged her career by accusing her of stealing information from company computers.

Federal agents later raided Ishkanian’s home and business, but she has never been arrested or charged. Her lawsuit seeks damages for emotional distress, libel, slander, and conspiracy.

Tepper said Wednesday the US Weekly lawsuit has limited her business, claiming others in the industry refuse to use her material. The magazine is appealing a judge’s ruling that refused to dismiss several of Ishkanian’s claims.

US Weekly said through a spokesman Wednesday night that it had no comment.

After leaving the magazine, Ishkanian helped form Sunset Photo and News, a paparazzi and celebrity reporting agency.

Struggling even to stand up, this picture shows Dynasty actress Heather Locklear being helped from a police car after being stopped for driving under the influence of prescription drugs.

Officers were called after Locklear was seen revving her engine loudly and repeatedly reversing over a pair of sunglasses in a car park in Santa Barbara, California.

She then stumbled about in moving traffic, it is claimed.

Police made the 47-year-old balance on one foot to see if she was sober – but she had to steady herself on a road sign.

Police said a witness, who didn’t recognise the star, reported that she had stopped on a nearby highway and left her car, apparently stumbling into traffic.

Alcohol was ruled out after tests but Locklear was charged with driving under the influence of prescription medication and released on £2,700 bail.

Patrol spokesman Tom Marshall said following the call from the resident, an officer found Locklear’s car parked on a state highway and blocking a lane in Montecito, a wealthy community about 90 miles northwest of Los Angeles.

She was believed to be alone in the car, Marshall said.

Locklear’s TV credits include police drama T.J. Hooker, Melrose Place and Spin City, and her film roles include The Perfect Man and Uptown Girls.

The actress checked into a medical clinic in June to seek treatment for anxiety and depression.

Last year, she was divorced from Bon Jovi guitarist Richie Sambora after 11 years of marriage. They have a daughter, Ava Elizabeth.

Neither her lawyer nor her publicist was available for comment.

Heather Locklear was arrested in Montecito, California on Saturday afternoon and booked for suspicion of driving under the influence of prescription medication, the Associated Press reports.

Calls to Locklear’s reps were not returned.

Locklear, 47, was pulled over by California Highway Patrol after a resident reported that she was driving “erratically.” Patrol spokesman Tom Marshall told the AP that the responding officer spotted Locklear’s car parked on a state highway blocking a lane. “In talking with her, the officer determines that she seems to be under the influence of something,” Marshall said.

Locklear was taken into custody, tested for drugs and alcohol, booked and released.

In June Locklear entered an Arizona inpatient facility for treatment for anxiety and depression.

After successfully completing four weeks of treatment for anxiety and depression, Heather Locklear is back home.

“Heather’s feeling really great,” says a close friend. “And she looks beautiful, just radiant.”

While the actress’s recovery is “a work in progress,” Locklear seems rejuvenated by her month away, says the friend. “She told a really funny story and she laughed from her core,” says the pal, who has seen Locklear since she returned home last weekend. “That’s when I knew she was going to be fine. I think that’s the best part of all – it’s so nice to hear her laugh.”

During her time at the Arizona facility, Locklear, 46, remained under doctors’ care while getting therapeutic spa treatments, riding horses and spending quality time alone. Her spirits were lifted by two visits from boyfriend Jack Wagner.

Since she checked herself in on June 19, Locklear has enjoyed the support of her ex, Bon Jovi rocker Richie Sambora. Their daughter Ava, 10, spent the last few weeks with Sambora but is now with her mom. Locklear is most excited, says the source, to be “back home with Ava.”

Still receiving treatment for anxiety and depression at an Arizona facility, Heather Locklear’s recent visit from her boyfriend Jack Wagner “really lifted her spirits,” says a close pal.

Wagner – who hadn’t seen Locklear since she left Los Angeles for the facility on June 19 – spent several hours with her last weekend, sources say. On Sunday, the two had lunch together in the facility’s dining area.

“He looked like he was taking care of her,” says an observer. “It was very sweet.”

Dressed down in sweats and a T-shirt, Locklear, 46, “looked exhausted,” says the observer. “Even with no makeup she was beautiful, but she seemed tired, pale and very skinny.”

Wagner, 48, chatted to Locklear, leaned in to kiss her on the forehead, and at one point during the otherwise quiet meal, says the observer, “He made her laugh.”

Far-Reaching Support
Locklear checked herself in to the facility for an in-depth evaluation on the suggestion of a doctor. She had been taking medication for anxiety and depression since after her 2006 split with Richie Sambora, with whom she has a daughter, 10-year-old Ava.

Among her biggest supporters since she entered treatment: her beau of more than a year, Wagner, as well as her ex.

“Heather has a few really close, trustworthy friends who are very protective and are pulling for her,” says the pal. “What she’s doing is so brave. Are some days tougher than others? Yes. But it will all be worth it when she’s back to being able to really feel the joy in every day.”

There is no timeframe on Locklear’s stay at the treatment center. “Once she’s feeling better,” says the friend, “She’ll come home.”

Heather Locklear is seeking treatment for psychological issues at an Arizona facility, her publicist confirms to PEOPLE exclusively.

“Heather has been dealing with anxiety and depression. She requested an in-depth evaluation of her medication and entered into a medical facility for proper diagnosis and treatment,” says Locklear’s rep, Cece Yorke. “This is a confidential medical matter and no further statement will be released.”
