Shia LaBeouf won’t face DUI charges for the July 27 car accident that crushed his hand, the L.A. County District Attorney’s Office announced Thursday.

“After reviewing the case, we’ve declined to file any charges due to insufficient evidence,” says DA spokeswoman Jane Robison.

Following the crash, the 22-year-old Transformers star was cited with misdemeanor DUI while he was still at the hospital.

Prosecutors instead plan to file criminal charges against the other driver, who was found to have run a red light, Robison says.

“We’re very happy with the prosecutor’s decision, and we’re glad this whole thing resolved without Shia having to go to court,” LaBeouf’s attorney Michael Norris tells PEOPLE

Although the DA rejected the case, LaBeouf still faces a DMV hearing Friday and the possible suspension of his driver’s license, L.A. County Sheriff’s spokesman Steve Whitmore tells PEOPLE.

“When an individual refuses to take a blood alcohol test, that person’s license is automatically suspended for six to nine months,” says Whitmore.

At the Sept. 16 premiere of his new movie Eagle Eye, LaBeouf’s hand was in a white protective guard and he kept it in his pocket most of the night.

“I’m just propped up right now to do Transformers 2,” LaBeouf told PEOPLE. “Then, when I get another surgery, I’ll start recovering. Right now, I’m getting through.”

Shia LaBeouf is healing well following a Hollywood car crash in July, in which the actor flipped his truck and emerged from the hospital with a cast on his left hand. But Shia told Access Hollywood’s Billy Bush, there is more surgery in his future.

“I’m working right now,” Shia told Billy during an interview to promote his upcoming thriller “Eagle Eye.” “We propped [my hand] together so I could get through ‘Transformers’ and then I’ll go have another surgery and be back to 100 percent.”

As previously reported on AccessHollywood.com, Shia was involved in a collision at the intersection of LaBrea and Fountain in Hollywood in late July. The crash, which authorities have since said was the fault of the other driver, who ran a red light, sent Shia by ambulance to Cedars-Sinai Medical Center. After he was arrested on suspicion of DUI, he underwent surgery to fix his injured hand.

In the new interview with Billy, set to air on Monday on Access Hollywood, Shia said the injury to his hand was worse than originally reported.

“They’re good,” he told Billy of his bandaged fingers. “They’re broken.”

Following the crash and surgery, Shia returned to the set of “Transformers: Revenge of the Fallen,” directed by Michael Bay. And the actor said very little of the production was interrupted due to his accident.

“He plows through,” Shia said of his director. “I think we had a day down, two days down, and then we got back to some second unit stuff that we had to get anyways, and I was back two or three weeks before anybody projected me coming back.”

Happily promoting his new movie “Eagle Eye,” which opens September 26, Shia told Billy he was thankful his accident injured only his hand.

“It could have been something else,” Billy said.

“It definitely could have been. I’m very grateful,” Shia responded.

Actor Shia LaBeouf was due to return to the set of the Transformers sequel on Thursday, less than three weeks after he shattered his left wrist in a car crash.

The 22-year-old, who was out and about in Los Angeles on Wednesday, underwent extensive hand surgery following the wreck and is still wearing a brace on his wrist.

His fingernails remain black due to bruising and bleeding under skin.

The Indiana Jones star was arrested on a suspicion of drink-driving when his Ford pick-up truck collided with another vehicle at a junction in West Hollywood around 3am on 27 July.

LaBeouf was taken to Cedars-Sinai Medical Center after injuring his left hand, head and knee.

The star was attempting a left turn at the crossroads of La Brea Avenue and Fountain Avenue when he collided with an oncoming vehicle and flipped his car.

The contents of LaBeouf’s car, including pizza boxes containing hot pizza, a brand new toilet seat in its box and a rucksack were thrown out of the car and strewn across the road.

Los Angeles County Sheriff’s Sgt. Scott Wolf said: ‘It was immediately apparent to officers responding on the scene that LaBeouf was intoxicated and he was subsequently placed under arrest.’

LaBeouf was booked for a misdemeanour charge of driving under the influence.

His female passenger and the driver of the other vehicle were not seriously injured in the smash.

However, police spokesman Steve Whitmore announced two days after the crash that LaBeouf ‘was not at fault’.

‘We have strong evidence that the other driver ran a red light,’ he added.

Shia LaBeouf is doing well following his recent car accident and resulting hand surgery according to Isabel Lucas, his co-star in “Transformers: Revenge of the Fallen.”

“We’re both fine and Shia’s fine as well,” Lucas told Access Hollywood on the red carpet at Hayden Panettiere’s Whaleman Foundation Benefit at Beso in Hollywood on Sunday. “His hand is healing well.”
As previously reported on AccessHollywood.com, LaBeouf was involved in a collision with another vehicle in Hollywood on July 27, one that saw his green Ford truck flip. Lucas was the star’s passenger in the incident.

While both actors were transported to a local hospital following the crash, Lucas was released, while LaBeouf was forced to undergo early morning surgery to his left hand.
Last week, Star reported that LaBeouf might have to have his pinky amputated, a story that the star’s rep debunked to Access.

“That story is a complete fabrication. Absolute gossip,” LaBeouf’s rep said.

Reality star Khloe Kardashian – who served 173 minutes in jail last week for a 2007 DUI charge – has some advice for actor Shia LaBeouf, who was arrested for DUI after getting into a car accident on Sunday.

“Just be smarter,” she told Usmagazine.com at the Annual Style L.A. Runway show benefitting the Facial Paralysis Foundation & Stop the Violence/Face the Music benefit, which she co-hosted with sisters Kim and Kourtney at the The Viceroy Hotel, Santa Monica, CA on Monday.

“Think about your actions and get a driver!” the 24-year-old counseled. “It’s so much cheaper in the long run!”

LaBeouf, 22, was arrested early Sunday morning following a night of boozing at West Hollywood’s Troubadour club. His 23-year-old Transformers co-star Isabel Lucas was a passenger in his truck when the accident occurred. LaBeouf required extensive hand surgery but police determined he was not at fault for the accident.

Khloe’s jail stint was short but dramatic.

“As soon as I got to Lynwood, there were three bomb threats, and so they put me in solitary confinement,” she told Ryan Seacrest on Monday. “They released me early because I was a threat to the prison.”

She pledged to “never” drink and drive again.

Expect to see the incident on Keeping Up with the Kardashians.

“We were filming already and we got the whole thing on tape,” Kim told Us.

Aside from jail, Khloe told Us that she’s having a “boring summer.

“I had a bunch of trips planned and we never went on any of them,” she said.

Shia LaBeouf was not to blame for an early-morning car wreck in Los Angeles, authorities said Tuesday, pinning fault on the other driver for apparently running a red light.

Also Tuesday, a person close to production of the “Transformers” sequel said LaBeouf’s passenger in the accident was Isabel Lucas, the 23-year-old Australian who plays a supporting role. The person asked not to be named because he was not authorized to release the information.

Sheriff’s spokesman Steve Whitmore says detectives have determined that the other driver, who has not been identified, ran the light and will also be cited. LaBeouf was booked for a misdemeanor DUI and underwent surgery for injuries to his left hand.

“He was not at fault,” Whitmore said of the “Transformers” actor.

LaBeouf’s pickup truck collided with another vehicle at 3 a.m. Sunday in West Hollywood. Lucas and the driver of the other vehicle were not seriously injured.

Lucas, who has not yet appeared in any American films but has several upcoming projects, has returned to production on “Transformers: Revenge of the Fallen,” which is due out next June, the person said. Melissa Kates, a publicist for LaBeouf, said he plans to return to work within a month.

LaBeouf was trying to make a left turn at the West Hollywood intersection of LaBrea and Fountain avenues when his pickup collided with another vehicle, rolling the truck over.

Shia LaBeouf may have more to worry about than the drunken- driving charge he got after crashing his truck with Australian hottie Isabel Lucas strapped in the passenger seat.

Lucas, one of LaBeouf’s comely co-stars in the upcoming “Transformers” sequel, has been dating actor Adrian Grenier for months.

The “Entourage” hunk was testy and had no comment Monday when asked how Lucas was feeling after the smashup with her other leading man.

As the Daily News first revealed, Lucas, 23, was in LaBeouf’s car when it collided with another vehicle at a West Hollywood intersection early Sunday morning and rolled. She was treated for minor bumps and bruises at Cedars-Sinai Medical Center and released.

“She was in the car….They’re friends,” a movie source said of the LaBeouf-Lucas connection. The source said the two have been working a lot of late nights on the set and most likely were together to let off some professional steam.

The source said Lucas was well enough to return to the “Transformers” set Monday and that movie production will work around the estimated 30 days LaBeouf needs to recover from “extensive” surgery on his left hand. “They’re making adjustments,” the source said, adding that the movie’s June 2009 release date remains “firm.”
“Shia is doing fine. He’s in good spirits. He’s resting,” his mom, Shayna LaBeouf, said during a hospital visit Monday.

The Los Angeles County sheriff’s department has charged LaBeouf with misdemeanor DUI after he turned into the path of an oncoming vehicle about 2:30 a.m. Sunday.
LaBeouf, who also appeared in “Indiana Jones and the Kingdom of the Crystal Skull,” showed “outward signs of intoxication” after the crash, a sheriff’s official said. He could face another misdemeanor charge based on the results of his blood-alcohol test.

Sheriff’s deputies originally deemed the incident a felony, but downgraded it after they followed LaBeouf, 22, to the hospital and determined the injuries to Lucas and the driver of the other vehicle were minor.
