Bret Michaels’ lawsuit over an accident at the 2009 Tony Awards that the singer claims nearly killed him should be heard in New York where the accident happened, a federal judge in Los Angeles has ruled.

It makes more sense for the case – which stems from Michaels being hit in the head by a set piece after performing at Radio City Music Hall – to be handled by a federal court in Manhattan, U.S. District Judge Dolly Gee wrote in a ruling Tuesday.

The Poison frontman sued CBS Broadcasting and Tony organizers in March in Los Angeles, claiming the accident contributed to a brain hemorrhage that nearly killed him. His attorneys argued the case should be heard on the West Coast since Michaels lives in Los Angeles and Arizona, as do some witnesses, including his manager and other workers.

Gee agreed with attorneys for Tony Awards Productions that much of the potential evidence and the vast majority of witnesses – including actors and production workers on the awards show – are in New York.

Michaels is seeking unspecified damages on claims that show organizers never explained that the set would be changing after the band performed “Nothin’ But a Good Time” during the 2009 Tony Awards. The accident broke his nose, and he contends it led to the hemorrhage that later left him hospitalized and forced him to cancel several concerts.

He also claims the show could have prevented the incident from airing, but chose not to. The clip of the accident became a viral hit on the Internet, with more than 27 million views on YouTube when the case was originally filed.

Email messages to spokespersons for the Tonys and Michaels’ attorneys were not immediately returned.

The Poison frontman’s lawsuit claims he continues to deal with effects from the injury and brain bleeding that left him hospitalized last year.

“Through his sheer will to live, to see his children grow up, Michaels was able to survive this trauma,” his lawsuit states.

Michaels and Poison performed at the Tony Awards in June 2009 and the singer suffered a busted lip and broken nose when he was whacked by a piece of scenery.

He claims show organizers never explained that the set would be changing after the band performed, “Nothin’ But a Good Time.” He also claims the show could have prevented the incident from airing, but chose not to.

Footage of the accident quickly became a viral hit on the Internet, and Michaels’ lawsuit claims clips have been viewed more than 27 million times on YouTube.

Michaels was hospitalized in April 2010 and doctors found he had a brain hemorrhage and he later suffered a warning stroke, which the musician says nearly killed him.

“Michaels was never told that the scenery piece would be descending or given any warning of the existence of the dangers it presented,” the lawsuit states.

CBS declined comment and has a policy not to respond to lawsuits outside of court.

Phone and e-mail messages left for spokespeople for the Tony Awards were not immediately returned Friday evening.

Within days of the accident, Michaels expressed dismay that Tony organizers hadn’t shown more concern about the incident.

“The Tony Awards dropped a piece of the stage on Bret’s head, and then instead of doing the right thing, joked about it and played it off for ratings,” Michaels’ attorney Alex Weingarten wrote in a statement.

He said Michaels tried to resolve the court without filing a case but was unsuccessful. “They must be held accountable for almost killing Bret, and that is what we are going to do,” Weingarten wrote.

His lawsuit does not state how much he is seeking to recover, although it states the injury hurt his ability to perform at later shows.

Charlie Sheen doesn’t just have his tiger blood to thank for busting up a Plaza Hotel room last year, Bret Michaels wants some credit too.

The Poison rocker has revealed he “professionally” taught the “Two and a Half Men” star how to trash a hotel room because Sheen “wasn’t doing a good job at first.”

“I said, ‘You gotta really let it out man! You gotta let it out and bust this stuff,’” Michaels told Access Hollywood.

The 48-year-old musician and Sheen reportedly met through a mutual Penthouse Pet friend and Michaels later directed the actor in two films, 1998′s “A Letter from Death Row” and “No Code of Conduct,” which also starred Sheen’s dad, Martin.

“He showed me how to do films and make money, and I showed him out to lose a lot of money by smashing up hotel rooms,” quipped Michaels, who has been open about his hard-partying past.

Meanwhile, Sheen has expanded his “Violent Torpedo of Truth/Defeat Is Not an Option” tour to include more dates and even hired a “sexy stenographer” to help him out.

This weekend, he tweeted a photo of him and the busty brunette working on a laptop with the caption, “the warlock hard at work.”

Though the 45-year-old actor is reportedly on track to make $7 million from his newly expanded live show, old friend Michaels was unsure whether to congratulate him.

“I don’t know if he’s winning or losing,” Michaels told Access Hollywood, adding, “maybe he’s just spilling out what he’s going through right now.”

Sheen tore up his Plaze Hotel suite last October in a drug-and-fuel boozed meltdown before being taken to hospital. Since then the actor has been on a public downward spiral with various medical experts suggesting he may have bipolar disorder.

Poison frontman Bret Michaels faced another health scare on Friday when his blood pressure dropped to dangerously low levels just days after he had heart surgery.

The rocker underwent an operation to repair a hole in his heart last week, months after doctors discovered the condition as they treated him for a near-fatal brain hemorrhage.

The surgery at a hospital in Phoenix, Arizona was hailed a success and Michaels was discharged on Wednesday to continue his recovery at home.

Now it has been revealed the star’s blood pressure plunged just two days later.

According to People.com, tests showed that the drop in blood pressure was due to dehydration and exhaustion rather than stemming directly from the operation.

Dr. Mansour Assar tells the website, “Bret suffered no setbacks and is fine. It’s always good for patients to be evaluated when they’re not feeling well.”

Doctors discovered the hole in the rocker’s heart in April while treating him for a brain hemorrhage.

A surgical team at St. Joseph’s Hospital and Medical Center was performing the procedure Monday. The hospital said the rocker would undergo a cardiac catheterization during which doctors planned to insert a catheter into a vein in the groin and guide wires and a closure device into the heart with cameras assisting doctors as they operate to close the hole.

The closure device remains in Michaels’ heart permanently to stop abnormal blood flow between the two chambers of the heart.

Doctors say without the procedure, Michaels risks developing blood clots and an additional stroke.

Rocker Bret Michaels has committed himself to a life of complete sobriety following his health nightmare earlier this year – because he refuses to kill himself drinking alcohol after battling to recover from his ailments.

The Poison star underwent an emergency appendectomy before collapsing from a near-fatal brain haemorrhage in April. He later suffered a stroke and was subsequently diagnosed with a hole in his heart.

Michaels has made a miraculous comeback from his health troubles and returned to the stage to complete his U.S. tour shortly after his hospitalisation, but he admits he’s not fully recovered.

He tells People magazine, “I’m only 85 per cent back, so I can’t kickbox. I have short-term memory loss, so I have to repeat things to myself over and over. And I haven’t had a good night’s sleep since. My goal next year is to rock harder and sleep more!”

And Michaels reveals he’s turned his back on his wild days of partying so he can keep rocking into old age and treasure the time he has with his girlfriend Kristi Gibson and their two kids, Raine, 10, and Jorja, five.

He says, “I haven’t had a drop of alcohol since my appendectomy. I didn’t fight through this to want to die…

“My thing now is spending time with Kristi and our daughters. I don’t want my legacy to be a haemorrhage. I want it to be: I’m a fighter, I’m passionate, I’m hardworking, and I love music.”

Michaels, who is also diabetic, is due to go under the knife in January 2011 to repair the hole in his heart.

Bret Michaels’ camp denies a report the rocker had an affair with Miley Cyrus’ mom, Tish, while she was married to singer Billy Ray Cyrus.

“This is someone stirring a pot. This is untrue. He respects the family and worked with Miley and Tish on a professional level,” said Michaels’ rep.

Reports claim that Michaels became close with the Cyrus clan after he and Miley recorded a song together, “Nothing to Lose.”

Tish and Billy Ray are splitting after 17 years of marriage and filed for divorce last week.
