The Monster’s Ball star returned to court on Friday for a hearing tabled after her lawyer, Neal Hersh, filed legal papers asking a judge to hold Aubry in contempt for allegedly violating their custody deal.

Tmz.com reports the latest spat came about during a dispute over how much time Berry and Aubry each get to spend with their daughter Nahla when the actress is shooting a movie abroad.

Berry is reportedly heading to Europe to shoot a new film and she wants to spend more time with Nahla.

A judge ruled in her favor and now Gabriel won’t get as much time with his daughter Nahla as he wanted.

The former couple’s custody battle began in December when the model filed a paternity petition asking to be officially recognised as the father of three-year-old Nahla following his split from the actress. At the time, Berry and Aubry had not filed for child custody, visitation or support.

She later challenged his efforts to spend more time with Nahla.

Halle Berry’s estranged sister is reaching out to the actress to let “bygones be bygones” after reading about the star’s recent child custody battle.

The Oscar winner has not spoken to her siblings in five years, but eldest sister Renee claims she can’t understand why Berry has cut them out of her life.

Renee insists she hates seeing the actress fighting for custody of her daughter Nahla with her ex Gabriel Aubry – earlier this week Berry was granted permission by a judge to travel with her daughter.

And her sibling is calling for Berry to get back in contact and let her family meet their niece.

Renee tells Britain’s Daily Mirror, “I’m sad to say it seems like she does not want anything to do with us. I have not spoken to her in about five years. I tried to contact her through her website, to congratulate her on her Oscar, but no one got back to me. She used to be very close to my brother Anthony, but she’s cut herself off from him now too. It makes us very upset – none of us understand why she feels the way she does…

“We are desperate to understand why Halle is so upset, why she feels she cannot be with us. Halle will always be my baby sister…

“It is sad because our grandmother Cora, who died in 2003, did not raise us to be apart like this… Halle needs to realize that at some point, you have to let bygones be bygones. You need to learn how to forgive.”

 

Halle Berry has emerged victorious in her custody battle with ex-boyfriend Gabriel Aubry after a judge granted her permission to travel with her daughter.

The actress became embroiled in a legal fight with Aubry in December, when the model filed a paternity petition asking to be officially recognized as the father of two-year-old Nahla following the couple’s split last year.

At the time, Berry and Aubry had not filed for child custody, visitation or support.

Berry subsequently quit a role in Garry Marshall’s romantic comedy New Year’s Eve, in which she was set to play Jon Bon Jovi’s lover, so she could focus on the court battle.

And, during a hearing in Los Angeles on Wednesday, a judge ruled Berry would be able to take Nahla with her on film shoots across the U.S.

The Oscar winner’s lawyer, Neal Hersh, tells TMZ.com, “We are pleased the judge took the time to deal with this very imminent and important issue. The judge read a great deal of paperwork and gave us time to argue.

“Halle is very pleased with the judge’s order.”

Aubry withdrew his custody petition following the ruling, but is continuing to pursue the paternity action.

As a result of the custody case, Berry has reportedly chosen to return to work on New Year’s Eve, although she will play a different role after Katherine Heigl was cast as her replacement.

 

The actress will play herself in the episode, which will air in America on February 20, 2011.

In the Hollywood-themed show, Berry’s animated self will present an Oscar to Bart Simpson for a short film he makes about his father Homer, titled Angry Dad.

The Simpsons’ animators used a favourite photo Berry gave them of her at the Oscars in an Elie Saab gown to create the actress’ cartoon self.

 

Halle Berry has pulled out of a film job to prepare for a custody fight over her young daughter. A spokeswoman for the Oscar-winning actress says Berry backed out of a role in “New Year’s Eve” that was scheduled to shoot in New York this week “due to pending custody litigation involving her daughter.”

Publicist Meredith O’Sullivan did not say where or when the custody case would be heard.

Berry and her ex-boyfriend, Gabriel Aubry, have a daughter, Nahla, who will turn 3 in March.

Attempts to reach Aubry on Monday were unsuccessful.
