The 50 year old – who is estranged from Lindsay following a number of public spats with her and her mother Dina – intends to petition for a conservatorship order, giving him control over the 24-year-old actress’ personal and professional affairs.

He said: “Since Dina and manager Lou Taylor are going to try and be co-conservators, I had a choice of fighting it or petitioning for the purpose of appointing two conservators who don’t have an interest in Lindsay’s money but rather her as a person and a human being.

“Dina and Lou have their hands in it, not their hearts.”

Earlier this week, Michael hit out at “disturbing” reports Dina and Lou were planning to get a court ordered conservatorship “without her knowing”.

He said: “I’ve learned of a plot to put Lindsay under a conservatorship. It’s disturbing, the co-conservators would be Dina and Lindsay’s business manager, Lou Taylor.

“Lou and Dina are trying to get her out of the picture so they can get a conservatorship without her knowing.

“They would control literally everything Lindsay does, what projects she has coming up, her finances and the people she sees-and that includes keeping me out of her life.”

Meanwhile, it has been confirmed Lindsay has entered rehab – for the fifth time – in Orange County, California.

A source said: “She is with us for the time being. We expect her to stay for the full 90 days, however, she could bounce because there is no court order to ensure she has to stay.”

Lindsay failed two drugs test earlier this month following a stint in prison and rehab – where she was sent after violating the terms of her probation for a 2007 driving under the influence (DUI) conviction – and was subsequently sentenced to four weeks in jail last Friday.

However, the ruling was overturned within a day and the ‘Machete’ star was released after posting $300,000 bail.

Lindsay is due back in court for a probation hearing on October 22.

Michael Lohan – who is estranged from his two daughters – admits he worries the 16 year old will end up being cared for by “Lindsay’s bimbo friends” when the ‘Mean Girls’ actress starts her 90-day jail sentence on July 20.

Explaining his decision to fly to Los Angeles for the 24-year-old star’s court hearing last week, he said: “I don’t think that anyone thought that Lindsay was going to go to jail except for me. I came out here because I knew it was a very, very possible thing. And my concern, at that point, was if Lindsay went to jail and Ali was with her and she’s only 16, who is she going to be with? Lindsay’s bimbo friends? So I had to be there.”

Michael was so worried about the teenager – who shares a Hollywood apartment with Lindsay – he even telephoned police from court last Tuesday after Lindsay was sentenced to jail, followed by 90 days in rehab, for violating the probation of her 2007 driving under the influence (DUI) charge.

He explained in an interview with ‘Access Hollywood’: “I knew there was going to be an issue, so I went and called 911. I called the Beverly Hills Police Department. I said, listen, ‘I’m Michael Lohan; my daughter Lindsay is just getting sentenced to jail time; they might take her away and my 16 year old is going to be on her own. I’m her father and I don’t know the people she’s with. I want to take her with me and I’m afraid there’s going to be a problem.’ ”

Despite Lindsay’s impending sentence, it has emerged she could earn over $500,000 from her first interview about the case.

A source said: “The irony is Lindsay is in demand. The bidding is over $500,000 for the rights to the pre-jail interview, the prison diary and the first chat when she is released.”

However, the actress is confident her term inside will be reduced over the next few days and is visiting a psychic to help learn her fate.

The source added to the New York Post newspaper: “Lindsay is still convinced she’ll get a reduced term – even if she has to go to rehab afterwards for longer. She has spoken to a number of lawyers over the weekend. She’s even seeing a psychic for guidance.”

Lindsay Lohan believes it was her father, Michael Lohan, who tweeted lies yesterday that she’s HIV-positive.

Lindsay, now 23, doesn’t believe her father’s claim that a hacker somehow accessed his Twitter account and posted the vicious remarks.

“He’s a grown man and has done the exact same things on TV/interviews, [so] why wouldn’t he lie on Twitter, and everywhere else!” she tweeted. “He just wants money — and he’s using me, my name, my status, my mother, brothers and sister for the cash to pay for [another] wedding.” Michael declared, “There is an imposter on Twitter . . . My attorney, Lisa Bloom, will be contacting the authorities to find out who is responsible for this criminal act of ID theft/impersonation.”

Lindsay Lohan’s father is preparing to jet to Los Angeles in a bid to persuade his troubled daughter to check into rehab – because he’s terrified she will die without professional help.

The Mean Girls star has earned herself a reputation as a Hollywood wildchild in recent years thanks to a string of boozy nights out, arrests for drug possession and driving violations and a stint in rehab.

The 23 year old hit the headlines again earlier this month when she was photographed falling into a cactus bed after a night out in Los Angeles. She was also snapped with a mystery white dust billowing from her designer shoes last week.

Michael Lohan, who has publicly spoken about his daughter’s alleged prescription drug addiction in the past, admits he’s seriously worried for the actress’ health – and he’s appealing for her to seek professional help before it’s too late.

During a press conference on Tuesday, he explained, “Lindsay’s not OK. I think we’ve seen that, we all know that. It’s really hard for me to do this. A lot of my family members know what’s going on.

“I’ve tried every way possible to reach out to my daughter – talking, text, we’ve met. And, in difficult times, she reaches out to me. It happened last week when she fell into the cactus. She said, ‘I need security.’ I’m her father and I love her.

“I think we all see and know what’s happening with Lindsay. I get calls from her closest friends and it’s worse than you can imagine. My daughter needs to let me help her. I don’t want her to be a statistic. My heart goes out to people who have lost their children.”

Michael Lohan is seeking to meet with his daughter’s legal team because he wants to help them rid the star of disruptive influences in her life.

He adds, “Lindsay needs help now and I’m asking everyone out there to help her and if you’re an enabler (to Lindsay) get out of there. I want to meet with Lindsay’s lawyers and sit down with her privately to work something out, discuss the situation.

“If she refuses to do so I guess we will take out measures. I hope Lindsay is accommodating. We all know the truth. God knows the truth. I love her and I want her to be healthy. Her life will not be taken from me.”

Michael Lohan’s press conference comes just weeks after he was reportedly hospitalised with with chest pains as he prepared for a celebrity boxing match.

He is reportedly taking medication to thin his blood, and is also on anti-angina drug nitroglycerin, according to reports.

Lohan made no mention of his medical condition during the press conference.

The outspoken father – who was taken to hospital last week after suffering chest pains during a celebrity boxing match – was rushed to St Francis Hospital in New York yesterday afternoon after complaining of feeling unwell, where it has since been confirmed by his journalist girlfriend Kate Major, that he suffered a heart attack.

She said: “He was short of breath all day. His blood pressure skyrocketed. Right now they’ve told him it looks like he had a minor heart attack but they are still doing tests on him.”

Michael, 49, had been in Miami making an appearance on the US ‘Geraldo’ show and had also been participating in a photo shoot with the reality TVfamily, the Kardashian’s.

Kate added: “Michael was in Miami. We just flew back to New York last night. But he didn’t feel well all day today.”

Michael – who was recently blasted by his actress daughter for suggesting she should be in rehab – is reportedly scheduled to have a procedure to clear his arteries on Friday.

Lindsay is currently in Los Angeles, although it is not known whether she has been in contact with her father.

Authorities say Lindsay Lohan’s father has been arrested again.

Police on New York’s Long Island say Michael Lohan was arrested Thursday morning and charged with criminal contempt. Police did not provide further details.

Bryan Konoski, an attorney for Lohan’s ex-girlfriend Erin Muller, has told the New York Post that Lohan allegedly phoned Muller at work Jan. 21. That would violate an order of protection.

Lohan had been arrested on a similar charge in December.

In June, a judge said Lohan would avoid prosecution on an aggravated harassment charge if he stayed out of trouble for a year. Lohan denied he threatened to kill his girlfriend and himself if she left him.

Lohan’s attorney had said his client is the victim of fabrications.

The actress reportedly is estranged from her father.

While at war with his ex-fiancée Erin Muller, Michael Lohan has been hanging out with Jon Gosselin’s ex, Kate Major.

Lohan and Major, a former reporter for Star magazine, were spotted at a string of bars in Chicago Sunday night and at an Asian eatery on Tuesday.

A spy said, “They partied until very late Sunday. On Tuesday, they went for dinner at restaurant Sunda and went outside for a cigarette. Kate kept talking about a ring that Michael bought her. She was wearing it on her middle finger. They then got chatting to a girl who looked just like Ali Lohan. Before they went inside, Michael told the lookalike, ‘You are a very beautiful girl.’ ” Lohan told us last night, “Kate and I are friends. She went to Chicago to visit her family after Christmas, and I had business in Chicago.”

In court papers, Erin Muller, who dated Lohan for 2½ years, alleges he “slapped [her] in the face twice because Erin accused him of giving her a fake watch on her birthday” in December 2007.

The following year, she claims, he “punched [her] in the mouth,” beat her with a “stiletto heel” and “put a lit cigarette out on her scalp.”

In November 2009, she claims, he became “extremely enraged and began punching [her] in the head with a closed fist” while in his car. Erin wants a Nassau County court to dismiss charges from Lohan that she kicked him in the head. Michael, the father of Lindsay Lohan, told Page Six, “All these allegations are a lie. If these things are true, why didn’t she complain about it years ago?” Muller’s lawyer didn’t return calls.

Just two days earlier, Dina took him to court for alleged nonpayment of $40,000 in child support.

She said, “It is sad that the day before Christmas Eve, I was back in court with Michael over child support. He claims he’s broke and can’t pay — yet he drives around in a Mercedes and has a house in the Hamptons. He got paid for selling tape recordings of private conversations relating to Lindsay, but he won’t pay for his children.”

But Dina said that despite battling with her ex, she was determined to have a happy celebration at home with her kids, including Lindsay, Ali and brothers Michael and Cody. Dina added, “A lot has happened, but we’ll end the year on a positive note. We always have a big celebration, we always invite all manner of strays and friends to join in.” Michael did not respond to our e-mails.
